Our sister was arrested a couple years ago and we were able to get around hiring a bondsman by putting up a 10% cash deposit with the jail. For her case, most of that money was refunded once everything was over. This is an excellent question. Bail law differs state by state and although some places in the US allow people to put up a refundable cash deposit with the jail, that’s not something that’s permitted in California. Here, the fastest way to get someone released from custody is to hire a bondsman but as you know, the fee paid to a bail bondsman is considered to be earned in full at the time the defendant is released from jail and it’s not refundable in part or in full no matter what happens with their case.
